1. Grant of License

- Film & Video: Movies, documentaries, commercials, advertisements, corporate videos, wedding videos (if sold), promotional videos
- Live Performances: Concerts, theatrical productions, dance performances, public events
- Derivative Works: Remixes, samples, mashups, covers, or incorporating the music into new compositions without permission
- Redistribution: Selling, renting, leasing, sublicensing, or distributing the music files to third parties
- Streaming Services: Uploading to Spotify, Apple Music, Amazon Music, or other music distribution platforms
- Synchronization: Syncing music with visual media of any kind for commercial purposes
- Background Music for Business: Using in apps, games, software, websites, on-hold music, or any business-related context
Important: Even if your YouTube channel, podcast, or social media content is not monetized, it still constitutes commercial use if it's publicly accessible. A paid license is required.
2. Copyright and Ownership
2.1 Copyright Protection
All music files available on this Site, including but not limited to compositions, lyrics, recordings, and productions, are original works created by NMH Music. All content is protected by:
- United States Copyright Law (Title 17, U.S. Code)
- International copyright treaties and conventions
- Digital Millennium Copyright Act (DMCA)
2.2 Ownership Rights

- Fraudulent Use: Use the music in any manner that is fraudulent, deceptive, or misleading
- Harmful Content: Associate the music with content that promotes violence, hatred, discrimination, illegal activities, or exploitation of minors
4. Commercial Licensing
4.1 How to Obtain a License
If you wish to use NMH Music for any commercial purpose, you must obtain a paid license before use. To inquire about licensing:

4.3 Retroactive Licensing
If you have already used NMH Music for commercial purposes without a license, you must contact us immediately to obtain retroactive licensing. Failure to do so may result in legal action and statutory damages.
5. Enforcement and Legal Remedies
5.1 Monitoring and Detection
We actively monitor the internet for unauthorized use of our music using:
- Content ID systems (YouTube, Facebook, etc.)
- Digital fingerprinting technology
- Manual searches and user reports
- Third-party copyright enforcement services
5.2 Consequences of Violation
Violation of these Terms may result in:
- Immediate Termination: Your license to download and use the music will be immediately revoked
- DMCA Takedown Notices: We will file takedown requests with platforms hosting unauthorized content
- Legal Action: Civil litigation for copyright infringement
- Statutory Damages: Under U.S. copyright law, statutory damages can range from $750 to $30,000 per work infringed, or up to $150,000 per work for willful infringement
- Injunctive Relief: Court orders to cease unauthorized use
- Attorney's Fees: Recovery of legal costs and attorney's fees
- Criminal Penalties: In cases of willful infringement for commercial advantage, criminal prosecution may result in fines and imprisonment
5.3 Good Faith Resolution
If you discover you have inadvertently violated these Terms, we encourage you to contact us immediately. In many cases, we prefer to resolve issues through licensing rather than litigation.

7. Warranties and Disclaimers

Music files are provided "as is" and "as available" without warranties of any kind, either express or implied. We make no guarantees regarding:
- Audio quality or file format compatibility
- Uninterrupted availability or error-free downloads
- Fitness for a particular purpose
- Merchantability
7.2 Third-Party Claims
While all music is original content created by NMH Music, we do not warrant that use of the music will not infringe third-party rights. However, to the best of our knowledge, all compositions, lyrics, and recordings are original works.
8. Limitation of Liability
To the maximum extent permitted by law, NMH Music shall not be liable for:

Our total liability to you for any claims arising from these Terms shall not exceed the amount you paid for the music (which for free downloads is $0.00).
9. Indemnification
You agree to indemnify, defend, and hold harmless NMH Music, its creator, affiliates, and representatives from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:
- Your violation of these Terms
- Your unauthorized use of the music
- Your infringement of any third-party rights
- Any false or misleading information you provide
10. Term and Termination
10.1 Term
These Terms remain in effect for as long as you possess or use any music files downloaded from this Site.
10.2 Termination by You
You may terminate this license at any time by:
- Permanently deleting all downloaded music files
- Ceasing all use of the music
- Removing any content containing the music from public platforms
10.3 Termination by Us
We may terminate your license immediately without notice if you violate any provision of these Terms. Upon termination:
- You must immediately cease all use of the music
- You must delete all copies in your possession
- You must remove any content containing the music from public platforms
- Sections covering ownership, prohibited uses, and legal remedies survive termination
11. Modifications to Terms
